1. Introduction
These Terms and Conditions (“Terms”) apply to all interior design services provided by David Wilder Design (“we”, “us”, or “our”) to any client (“you” or “the client”). By engaging our services, you agree to be bound by the Terms outlined below.
2. Scope of Work
The scope of our services will be clearly defined in our proposal or quotation. Any additional work requested that falls outside of this scope may incur additional charges, subject to agreement in writing.
3. Fees and Payment
- Fees for services are outlined in the quotation provided and are subject to VAT where applicable.
- A deposit is required prior to commencement of design work or procurement of materials.
- Invoices must be paid in full by the due dates specified. Late payments may result in delays or suspension of services.
4. Project Timelines
Project timelines and delivery dates are estimates and subject to change based on design revisions, supplier lead times, and client approvals. We will always endeavour to meet agreed deadlines when reasonably possible.
5. Client Responsibilities
- You agree to provide timely feedback, approvals, and any information necessary to progress the design process.
- Delays in communication or decision-making may affect the overall timeline and delivery of the project.
6. Ownership and Intellectual Property
All designs, presentations, presentation materials, mood boards, drawings, specifications, concepts, and physical samples remain the intellectual and physical property of David Wilder Design.
Should the client decide not to proceed with the quoted project, items, or products, all such materials must be returned to David Wilder Design upon request, and may not be reproduced, shared, or used in any way without our prior written consent.
7. Cancellation and Termination
- You may cancel the project at any time in writing; however, fees for work completed to date, including costs incurred on your behalf, will still be payable.
- David Wilder Design reserves the right to withdraw from the project if the client breaches these Terms, including non-payment of fees.
8. Product and Supplier Lead Times
We work with third-party suppliers to source products and materials. While we do our best to manage timelines, we are not responsible for delays caused by third parties.
9. Warranty and Product Defects
- We take care to source quality products and materials from reputable suppliers. However, warranty and defect coverage lie with the individual manufacturer or supplier of each item.
- We will assist with initial communications regarding warranty claims where possible, but we are not liable for any damages, delays, or faults caused by third-party goods or workmanship.
- Any installation or contractor services not directly managed by David Wilder Design fall outside our scope of warranty responsibility.
10. Limitation of Liability
David Wilder Design shall not be liable for any indirect, incidental, or consequential damages arising from the use or implementation of our design work. Liability is limited to the total amount paid by the client for the specific service.
11.Governing Law
This agreement is governed by the law of England and Wales.
